Terms of Sale

These Terms of Sale (the "Terms of Sale") govern the online sale of hotel accommodation nights booked through the Unisotel platform (the "Site"), accessible at www.unisotel.fr.
Unisotel is a commercial brand operated by the HONPO group. The Site is published by SAS HONPO, a simplified joint-stock company (société par actions simplifiée) with a share capital of EUR 52,800.00, registered with the Paris Trade and Companies Register (RCS) under number 521 436 238, whose registered office is located at 39 avenue Pierre 1er de Serbie, 75008 Paris (intra-Community VAT number FR08 521436238).
1. Purpose and scope
1.1. These Terms of Sale apply to any booking of a night's accommodation made on the Site by a customer (the "Customer"), whether acting in a personal or professional capacity.
1.2. Any booking implies the Customer's full and unreserved acceptance of these Terms of Sale. The Customer acknowledges having read and accepted them before confirming their booking.
1.3. The applicable Terms of Sale are those in force on the day of booking. Unisotel reserves the right to amend them at any time; the amended Terms of Sale apply only to bookings made after they are published online.
2. Identity of the seller
2.1. The night's accommodation is sold by the company that operates the booked hotel (the "Seller"). Depending on the hotel chosen by the Customer, the Seller may be a different company of the HONPO group, including in particular:
- SAS FYL GOOD ECO ("FGE1"), SAS with a share capital of EUR 100,000.00, RCS Paris 914 277 504, registered office at 39 avenue Pierre 1er de Serbie, 75008 Paris, intra-Community VAT number FR93 914277504;
- SAS FYL GOOD ECO 2 ("FGE2"), SAS with a share capital of EUR 5,000.00, RCS Paris 921 278 446, registered office at 39 avenue Pierre 1er de Serbie, 75008 Paris, intra-Community VAT number FR91 921278446.
2.2. The identity of the operating company (Seller) of the booked hotel is communicated to the Customer at the latest on the invoice issued for the stay. It may also be obtained at any time, before or after booking, upon simple written request to support@unisotel.com.
2.3. The booking platform is operated by SAS HONPO in the name and on behalf of the group's operating companies. The accommodation contract is concluded between the Customer and the Seller; the accommodation service is provided and invoiced by the Seller.
3. Booking process
3.1. Bookings are made online, via the Site. The Customer selects the hotel, the dates of stay, the room type and, where applicable, the options offered.
3.2. The Customer provides the information required for the booking (in particular surname, first name, e-mail address, contact details) and undertakes to provide accurate, complete and up-to-date information. The Customer is solely responsible for any errors or omissions in the information provided.
3.3. Before confirmation, a summary of the booking is presented to the Customer, indicating in particular the hotel, the dates, the total price and the applicable rate conditions. The Customer checks this summary and corrects any errors before confirming.
3.4. The booking is deemed firm and final upon validation of payment under the conditions of Section 5. A confirmation e-mail summarising the booking is then sent to the Customer at the address provided. This e-mail constitutes the conclusion of the contract.
4. Prices, taxes and tourist tax
4.1. Room prices are shown in euros, inclusive of all taxes, including value added tax at the applicable rate in force.
4.2. The displayed price covers the night(s) and the services expressly mentioned at the time of booking. Any additional service consumed on site and not paid for at the time of booking is invoiced separately by the hotel.
4.3. Tourist tax. The tourist tax (taxe de séjour) is not included in the room price. It is levied according to the scale set by resolution of the municipality (or the inter-municipal public cooperation body) where the hotel is located, and varies according to the municipality and the accommodation category. Depending on the hotel, it is collected at the time of booking or paid directly to the hotel during the stay. No tourist tax amount is guaranteed by these Terms of Sale: only the municipal scale in force on the day of the stay is authoritative.
4.4. The applicable prices are those displayed at the time of booking. Subject to a manifest pricing error, the price validated at the time of booking is not subject to subsequent revision.
5. Payment methods and terms
5.1. Unless special conditions attach to a specific rate, payment of the full price is due at the time of booking.
5.2. Payment is made online by bank card, via the secure payment gateway Lyra / Société Générale. Payment data is processed directly by the payment provider through a secure form; Unisotel and the Seller do not have access to the Customer's full bank card details.
5.3. The bank cards accepted are those indicated to the Customer on the secure payment page at the time of the transaction.
5.4. The booking is confirmed only after the payment has been accepted by the payment provider and its gateway. If payment is declined, the booking is not concluded.
6. Cancellation and modification
6.1. Cancellation and modification conditions depend on the rate type chosen by the Customer. These conditions are indicated at the time of booking and restated in the confirmation e-mail. The Customer is invited to read them before confirming their booking.
6.2. Refundable rate. Where the Customer has booked a refundable rate, the booking may be cancelled free of charge up to 24 hours before the scheduled arrival date (local time of the hotel). After this deadline, or in the event of a no-show, the full amount of the booking is retained by the Seller.
6.3. Non-refundable rate. Where the Customer has booked a non-refundable rate, the booking cannot give rise to any refund in the event of cancellation, modification or no-show. The price paid is retained in full by the Seller.
6.4. Cancellation or modification requests are made from the customer area of the Site ("My bookings" section) or by e-mail to support@unisotel.com.
6.5. Where a refund is due, it is made using the same payment method as that used at the time of booking, no later than fourteen (14) days after the cancellation.
7. No right of withdrawal
7.1. In accordance with Article L. 221-28, 12° of the French Consumer Code (Code de la consommation), the fourteen (14)-day right of withdrawal provided for distance contracts does not apply to accommodation services to be provided on a specific date or during a specific period.
7.2. Consequently, the Customer has no right of withdrawal for their room booking. Only the cancellation and modification conditions provided for in Section 6, according to the rate chosen, apply. The Customer is expressly informed of this absence of a right of withdrawal before confirming their booking.
8. Liability
8.1. The Seller is responsible for the proper performance of the booked accommodation services and for their conformity with the description shown on the Site.
8.2. The Customer undertakes to comply with the hotel's internal rules as well as the check-in and check-out times communicated. Any damage or any behaviour contrary to these rules may give rise to charges or appropriate measures by the hotel.
8.3. SAS HONPO, in its capacity as operator of the booking platform, is responsible for the proper functioning of the Site and of the online booking process. The accommodation service falls under the Seller's responsibility under the conditions of Section 8.1.
9. Complaints and consumer mediation
9.1. Any complaint relating to a booking or a stay must be submitted within fifteen (15) days of the end of the stay, to: support@unisotel.com.
9.2. Consumer mediation. In accordance with Articles L. 611-1 et seq. and R. 612-1 et seq. of the French Consumer Code (Code de la consommation), the consumer Customer has the right to have recourse, free of charge, to a consumer mediator with a view to the amicable resolution of a dispute with the Seller, after having first attempted to resolve the dispute directly with Unisotel by means of a written complaint.
9.3. The contact details of the competent consumer mediator are communicated to the Customer upon written request sent to support@unisotel.com and will be published on this page as soon as they are updated.
10. Personal data
10.1. Personal data collected in connection with the booking is processed in accordance with the Site's Privacy Policy.
10.2. For any question relating to the processing of their data or to exercise their rights, the Customer may write to: privacy@unisotel.com.
11. Force majeure
11.1. Neither party may be held liable for a failure to perform its obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code (Code civil) and the case law of the French courts.
12. Governing law and disputes
12.1. These Terms of Sale are governed by French law.
12.2. Prior to any legal action, the parties shall endeavour to resolve their dispute amicably, in particular through the consumer mediation provided for in Section 9. Failing an amicable resolution, any dispute falls within the jurisdiction of the French courts, under the conditions provided for by the applicable legal provisions. For professional Customers, any dispute falls within the exclusive jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal.
